HC writ challenges cancellation of Ad-din hospital’s licence

A lawyer of the Supreme Court has lodged a writ petition with the High Court seeking to overturn the Directorate General of Health Services’ (DGHS) decision to revoke the licence of Ad-din Medical College Hospital in Moghbazar, Dhaka.

Advocate Yunus Ali Akand, who filed the public interest litigation on Monday (15 June), said the petition also challenges the law under which the hospital's licence was cancelled.

Speaking to reporters, Akand said the court should examine the constitutional validity of the ordinance itself.

The DGHS cancelled the Ad-din hospital’s licence through an order issued on 11 June after an investigation into the deaths of six newborn babies at the facility in May.

The order noted that, under Section 12 of the relevant ordinance, the hospital is entitled to seek a review or appeal the decision before the government within 30 days of the licence revocation.

The six infants died at the hospital on 27 May, leading authorities to form an inquiry committee under Section 11(1) of the Medical Practice and Private Clinics and Laboratories (Regulation) Ordinance, 1982.

Following the investigation, the DGHS served a show-cause notice on 4 June, asking the hospital to explain why regulatory action should not be taken against it.

The Ad-din hospital was initially required to submit its response by 7 June, although the deadline was later extended at its request.

After examining the explanation provided by the hospital, the authorities determined that the response failed to adequately address the concerns raised.

The DGHS subsequently revoked the hospital’s licence under Section 11(2) (b) of the ordinance.
