The High Court on Thursday declared the candidacy of BNP candidate Sarwar Alamgir, who won the Chattogram-2 (Fatikchhari) constituency in the 13th National Parliamentary Election, to be valid, clearing the way for him to take the oath as a Member of Parliament.
A High Court bench comprising Justice Fahmida Quader and Justice Md Asif Hasan delivered the verdict on Thursday (9 July).
The court had earlier fixed Thursday for delivering its judgment after concluding hearings on a rule questioning the legality of the Election Commission's decision to cancel Alamgir's nomination.
According to court documents, the Election Commission had rejected his nomination paper on the grounds of loan default.
Sarwar Alamgir subsequently filed a writ petition with the High Court, which stayed the Election Commission's decision and allowed him to contest the election.
Later, Nurul Amin, a Jamaat-e-Islami-backed candidate, appealed against the High Court order. While the Appellate Division permitted Sarwar Alamgir to contest the election, it directed that the result of the Chattogram-2 constituency should not be published until the appeal was disposed of.
Sarwar Alamgir won the Chattogram-2 seat in the 13th National Parliamentary Election held on 12 February. However, the final result and official gazette notification for the constituency had remained pending due to the court's earlier directive.
With Thursday's High Court ruling upholding the validity of his candidacy, there is now no legal obstacle to his being sworn in as a Member of Parliament.
